Government Resolution #940 from October 24, 2013, brought into effect in Russia the United Nations Convention on the Use of Electronic Communications in International Contracts from November 23, 2005.
The Convention applies to use of electronic communications in relation to conclusion or fulfillment of contracts between commercial entities established in different countries. Article 8 of the Convention recognizes the legal force of electronic communications.
Russia will employ the Convention in cases when parties of an international contract have agreed to apply it. A series of restrictions are also implemented. In particular, in accordance with Article 19, Paragraph 2 of the Convention, Russia will not apply the Convention to transactions for which Russian legislation establishes a notarial form or a requirement for the state registration, and for sales transactions prohibited or restricted for transfer across customs border of the Customs Union.
Implementation of the Convention will allow Russian participants in foreign trade activities to lower expenses for organizing and conducting negotiations, and the execution and conclusion of foreign economic agreements.
