In Russia the question about the relevance of introducing criminal liability against legal entities is being the subject of active discussions. This question has been raised repeatedly, however , all previous attempts to make amendments in the Code were not successful.
Practice of criminal liability of legal entities is widely spread around the world, according to specialists its implementation will allow to considerably decrease the whole number of economic crimes and violations of anti-corruption legislation. Secondly, the experts are sure, that budget funds will be consumed more effectively and transparently.
But it should be understood that this practice has its disadvantages. In particular, unscrupulous businessmen can use criminal liability in order to eliminate competitors from the market by providing law enforcement authorities false information and initiation of the proceedings, during which time the activities of a legal entity will be suspended.
At the moment in Russia has been set a course on increasing business transparency. For instance, recently Unified state register of legal entities has been significantly “cleaned”. Making amendments in Penal Code can become a new step in improving business climate in Russia.
