What Are MinFin’s Letters For?

The Ministry of Finance’s (MinFin’s) letters on the application of tax laws are not aimed at establishing, modifying or repealing laws. These letters are not official commentary on the Tax Code, nor are they normative regulatory acts or acts that are applied once an arbitration court has reviewed a case. The Government does not even require that the letters be officially published. So what exactly is their purpose?
MinFin’s letters are intended to provide information and clarification. They express MinFin’s position on issues pertaining to taxpayers. MinFin expressed their views on this matter in Letter N 03-02-08/43, dated May 27, 2009.
