On May 5, 2014, President Putin signed into force Federal Law #106-ФЗ “On Introduction of Changes To Certain Legislative Acts of the Russian Federation.”

In compliance with the new law, starting January 1, 2014, accreditation of permanent representations and branch offices of foreign organizations will be conducted according to new regulations.

Currently, the State Registration Chamber and the Chamber of Commerce and Industry act as authorized federal agencies issuing documents confirming registration of foreign companies added to the unified state register of foreign legal entities.

Starting January 1, 2015, the function of accreditation of representations and branch offices of foreign legal entities (except credit organizations) will be placed, tentatively, on the Russian Federal Tax Service (FTS).

The FTS will develop new procedures, forms and formats of documents required for accreditation, introducing changes to existing registry data, termination of activity of accredited representation and branch offices.

Information of previously accredited branch offices and representations of foreign legal entities will be integrated into the state register and published on the official internet portal of the FTS.

To be added to the state register, branch offices and permanent representations of foreign legal entities that were accredited and received permits for opening branch/representation offices in Russia prior to coming into power of the new Federal law, and whose term of accreditation or permit expires after April 1, 2015, have to file the registration data with the FTS before April 1, 2015.

Accreditation of branch/representation offices of legal entities and permits for opening representation offices of foreign legal entities who fail to submit required information prior to April 1, 2015, will be canceled as of this date.

Previously accredited branch/representation offices whose accreditation/representation permit expires between January 1-31, 2015, may apply to FTS for new accreditation in accordance to the Federal Law N 160-ФЗ from July 9, 1999 “On Foreign Investments in Russia” (as presently in force) between February 1-28, 2015.

Personal accreditation of employees of branch/representation offices of legal entities after January 1, 2015, will be conducted only by the Chamber of Commerce and Industry (currently – by the State Registration Chamber and the Chamber of Commerce and Industry both).

The Chamber of Commerce and Industry will also establish new procedures for accreditation of foreign employees. Instead of the currently issued card of personal accreditation (service card), a new certificate of personal accreditation will be issued.

Accreditation of foreign citizens employed by foreign credit organizations will be conducted by the Bank of Russia.

The Bank of Russia will be able to lend assistance for processing documents for entry and residence in Russia to foreign citizens employed by foreign credit organizations and their family members.

The Law comes into power on January 1, 2015.
